1. Pledge on Privacy

The term “Personal Data” as used in this Policy refers to information about you that can be used to identify you, such as your name, birth date, e-mail address or mailing address.

In processing your Personal Data, we pledge to fully comply with internationally recognized standards of privacy protection. In so doing, we ensure compliance by our staff with strict standards of security and confidentiality. As a general rule, TheHealthChannel.com will not process your Personal Data without your consent. There may be exceptions to this rule, such as where we are required by law to process your Personal Data.

The next sections explain how and when we collect Personal Data from you.

2. How Do We Collect and Use Personal Data?

We may collect various types of data from you, depending on how you interact with our Site, as set out below. This information is collected directly from you, or generated automatically as you interact with our Site and services.

  • Contact Us Forms. You may submit questions or comments to us using the Contact-Us form on our Site. This form collects your first and last name (optional) and your email address (mandatory). We use this information to respond to your question or comment. Please do not provide us with any sensitive Personal Data on this form.
  • Email Newsletters. We may use the email address you provide to us to contact you with certain product, health, or other information that may be relevant to you. You may unsubscribe to these emails at any time using the unsubscribe link provided in the emails.
  • Location Tracking. The Site will determine your country of origin based on the IP address from which you are accessing the Site. We use this information to control the content that is available to you on the Site, to comply with our content licensing restrictions. This information is not combined with any other information we collect about you, and therefore does not constitute Personal Data.
  • Google Analytics. Our Site uses Google Analytics, which uses cookies and other similar tracking technologies to collect basic usage information about Site visitors (e.g., pages visited, links clicked, time spent on a page, referring source, etc.). This information is not identifiable and, therefore, does not qualify as Personal Data. We use this information on an aggregated basis to understand how visitors engage with the Site, in order to improve our Site design and functionality. Google will process this data in accordance with its own privacy policies. 3. How Do We Share Personal Data?

TheHealthChannel.com will not sell, share or otherwise distribute your Personal Data to third parties outside TheHealthChannel.com, except as described in this Policy or our notices to you. Personal Data may occasionally be transferred to third parties who act for or on behalf of TheHealthChannel.com.

Currently, we may transfer the information collected through the Site to the following third parties and in the following circumstances:

  • Website Developers and Hosting Providers. TheHealthChannel.com uses third parties for website development and hosting services. These providers may process website visitor data in the course of hosting our Site and providing maintenance, troubleshooting, and website improvement services to us.
    • Akismet:
      • We collect information about visitors who comment on Sites that use our Akismet Anti-spam service. The information we collect depends on how the User sets up Akismet for the Site, but typically includes the commenter’s IP address, user agent, referrer, and Site URL (along with other information directly provided by the commenter such as their name, username, email address, and the comment itself).
    • Google Web Fonts:
      • For uniform representation of fonts, this page uses web fonts provided by Google. When you open a page, your browser loads the required web fonts into your browser cache to display texts and fonts correctly.
      • For this purpose, your browser has to establish a direct connection to Google servers. Google thus becomes aware that our web page was accessed via your IP address. The use of Google Web fonts is done in the interest of a uniform and attractive presentation of our plugin. This constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO.
      • If your browser does not support web fonts, a standard font is used by your computer.
      • Further information about handling user data, can be found at https://developers.google.com/fonts/faq and in Google’s privacy policy at https://www.google.com/policies/privacy/.
    • Vimeo:
      • Our website uses features provided by the Vimeo video portal. This service is provided by Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA.
      • If you visit one of our pages featuring a Vimeo plugin, a connection to the Vimeo servers is established. Here the Vimeo server is informed about which of our pages you have visited. In addition, Vimeo will receive your IP address. This also applies if you are not logged in to Vimeo when you visit our plugin or do not have a Vimeo account. The information is transmitted to a Vimeo server in the US, where it is stored.
      • If you are logged in to your Vimeo account, Vimeo allows you to associate your browsing behaviour directly with your personal profile. You can prevent this by logging out of your Vimeo account.

  • Business Transactions. Subject to applicable law, we may also disclose your Personal Data to third parties in connection with a prospective or completed business transaction, including a merger, loan, sale or transfer involving all or part of the company or its assets or as part of a reorganization or restructuring or other change in legal form or corporate control.
  • Compelled by Law. TheHealthChannel.com and its service providers may disclose Personal Data in order to comply with applicable law and government requests. We may also be compelled by legal action to release information in connection with statutory reporting obligations, search warrants, court orders, subpoenas, summons, discovery obligations, bankruptcy or insolvency proceedings or other legal requests.
  • Other. We may disclose Personal Data to other parties with your consent, or where such disclosure is otherwise permitted or required by applicable law.

Where we disclose Personal Data to a third party, we will take steps to ensure that the third party processes Personal Data within the limits under which the data was originally collected. Such third parties may operate under different privacy policies.

4. Foreign Transfers of Personal Data

We may transfer your Personal Data to one of TheHealthChannel.com databases outside your country of domicile, such as the US. Similarly, if you are located in Quebec, your Personal Data may be communicated outside of Quebec. Accordingly, your Personal Data may be accessible to foreign courts, law enforcement and national security entities in such countries.

If you are located in Alberta, you may contact our our Privacy Officer at privacy@thehealthchannel.com to (i) obtain written information about our policies and practices with respect to service providers outside Canada; or (ii) ask questions about the collection, use, disclosure or storage of Personal Data by service providers outside Canada for or on our behalf.

This Policy applies only to this Site to the exclusion of third-party websites. TheHealthChannel.com may provide links to other websites that we believe may be of interest to our visitors. We aim to ensure that such websites are of a high standard. However, we are not responsible for and have no control over information that is submitted to or collected by third party websites. We encourage you to review the privacy policies of all websites you visit.

6. Personal Information and Children

TheHealthChannel.com will not knowingly collect, use or disclose Personal Data from a minor under the age of 14, without obtaining prior consent from a person with parental responsibility (e.g., a parent or guardian) through direct off-line contact. We will provide the parent with (a) notice of the specific types of Personal Data being collected from the minor, and (b) the opportunity to object to any further collection, use, or storage of such information. TheHealthChannel.com abides by laws designed to protect children.

7. Security and Confidentiality

To ensure the security and confidentiality of Personal Data that TheHealthChannel.com collects on-line, TheHealthChannel.com uses data networks protected by industry standard physical, technical and organizational safeguards. These safeguards include firewall and password protection. Access to Personal Data is restricted to those employees who have a need to use the data and who have been trained to handle such data properly and observe strict standards of confidentiality. If an employee breaches our policies and procedures he/she will be disciplined accordingly. Staff compliance with our policies and procedures is regularly audited and reviewed. Nonetheless, we cannot 100% guarantee the security of any information submitted over the internet or stored on electronic systems.

8. How Long Will We Retain Your Personal Data?

We only keep your Personal Data for as long as necessary to fulfil the purposes for which the information was collected, unless a longer retention period is permitted or required in order to comply with applicable law and defend the company from legal claims. When the period has expired, we will securely dispose of your Personal Data in accordance with legal requirements.

9. Roles and Responsibilities Within Our Organization

The Personal Data that we collect is accessible to employees within TheHealthChannel.com that need access to such data in order to perform their duties. These include technical support, marketing and IT personnel (as applicable). The following roles are responsible for the Company’s compliance with privacy laws.

  • Our Privacy Officer has been appointed to be responsible for our compliance with applicable privacy laws in Canada and the United States. This role has overall responsibility for our compliance with applicable privacy laws, including by ensuring resources are allocated for privacy and data protection measures and approving this Policy and any major changes to data protection practices. This role is also responsible for employee training and responding to privacy inquiries and data subject requests.
  • Our development team lead oversees our data security program, including by (i) implementing security protocols and measures; (ii) monitoring systems for security breaches; (iii) conducting vulnerability assessments and penetration tests; (iv) responding to and mitigating security incidents; and (v) ensuring data encryption and secure storage practices.
  • Our human resources team manages employee privacy, including by (i) ensuring it is collected, used and stored in compliance with our privacy policies; (ii) maintaining confidentiality agreements; and (iii) handling employee privacy-related inquiries and concerns.
  • All other personnel are responsible for: (i) protecting the confidentiality and security of any Personal Data they handle in connection with their employment; (ii) following our security measures and policies and procedures for handling Personal Data; (iii) refraining from any unauthorized access, use or disclosure of Personal Data; and (iv) reporting security or confidentiality incidents.

10. Exercising Your Privacy Rights

You may have various data privacy rights, depending on the jurisdiction in which you are located and the applicable laws. The rights set out below are subject to any limitations under applicable law.

  • Access: You may request access to your Personal Data.
  • Correction: You may request correction of any inaccurate Personal Data.
  • Withdrawal of Consent: You may withdraw your consent to the continued collection, use, and disclosure of your Personal Data. Withdrawing consent may impact the availability of certain services or Site features. You can withdraw consent by contacting us.
  • Unsubscribe. You may unsubscribe to our marketing emails at any time by clicking the unsubscribe button in any email to you, or by contacting us as set out below.
  • Portability: If you are a resident of Quebec, as of September 22, 2024, you can request a copy of your Personal Data in a structured, commonly used technological format.
  • Complaint. You may submit a complaint to us about our handling of your Personal Data.

To exercise any of your privacy rights, please contact us at privacy@thehealthchannel.com. Your requests will be dealt with in a prompt and proper manner, in accordance with applicable laws. Note that we may need to verify your identity in order to process your request. TheHealthChannel.com may also charge a small fee to cover its costs, where permitted by law.

11. Complaint Process

Our Privacy Officer handles complaints related to privacy matters. Our process for dealing with complaints related to the protection of Personal Data generally includes:

  1. Acknowledgement of receipt without undue delay;
  2. Appropriate steps to confirm the identity of the complainant, and to obtain the details of the complaint as well as any relevant documentation;
  3. Consideration of applicable laws;
  4. An appropriate, fair and impartial investigation, escalating the complaint as needed; and
  5. Communicating the outcome of the investigation to the complainant, including any remediation measures we take (where justified).
